Booking Terms & Conditions
Placing a Reservation.
A 20% booking deposit is required at the time of booking to confirm your reservation. This amount will be credited towards the final balance. On receipt of this deposit you will receive an updated confirmation that will inform you when your outstanding balance is due – 8 weeks prior to arrival.
Cleaning fees are applicable for all bookings, 5 nights or less. If the booking is 6 nights+ the owner will pay the fee.
Outstanding Payments.
The outstanding payment will be due to us eight weeks prior to your arrival dates. If a booking is made less than eight weeks prior to you arrival dates, the whole amount will be due at the time of booking. Payments may be made by check, bank transfer or through Paypal. (please note that Paypal charge a 3.5% commission).
Changes to bookings.
If possible, we will make all attempts to accommodate any changes to the booking made. We will require written confirmation of any changes you wish to make to the booking, on receipt of written notification we will advise you if we are able to accommodate the changes requested.
Cancellations – Please read thoroughly.
All cancellations must be made in writing. We will attempt to assist in altering dates to suit. However, please note that we do not refund deposits.
Equally you are able to cancel your booking 4 weeks prior to arrival with a full refund, less the 20% deposit paid.
Cancellations made up to 15 days before the arrival date are responsible for 50% of the full amount.
Cancellations made less than 15 days prior to arrival will be held liable for the total amount due, unless the booking dates are changed to another suitable date.
There are no refunds for late arrivals or early departures.
Security Deposit.
A $250 (refundable) security deposit shall be held for all rentals. We take pride in our home and expect that guests will do likewise, and treat the accommodation with the respect it deserves. There are certain regulations that we MUST adhere to in Florida and to ensure that security deposit deductions are avoided, please read and understand the following – There are NO exceptions.
1. Damage to Property: Including but not limited to stains on carpet & furnishings.
2. Loss of Property: Including but not limited to linens & towels.
3. Trash Removal: All remaining trash is to be bagged and placed in the garage at departure. There are two trash collection days each week at the villa. All trash information is clearly displayed on the refrigerator and also in the guest manual. It is your responsibility to set out the trash for collection. Failure to do so will result in excessive trash build-up for which there is a $50 charge.
4. Unauthorized Pets: Ejection from property and loss of security deposit.
5. Smoking in the house: Ejection from property and loss of security deposit.
6. Occupancy Number: If the number of occupants exceeds the number listed on the rental agreement, you will be ejected from the property and lose your security deposit.
7. Tampering with locked closets or pool equipment: Loss of security deposit.
8. Time of Departure: Checkout time is 10am. Unauthorized late checkouts will be charged up to a night’s rental. PLEASE CALL AND ASK.
9. Tampering with Pool and Smoke Alarms: This is a violation of Florida Law with up to a $5000 fine.
10. Placement of Furnishings: All furniture is to be left in or returned to its original location at departure. Failure to do so will result in a $50 fine.
11. Changes to reservations: Changes to reservations are subject to availability.
12. Liability: Neither the property owners nor the Management Company, or its agents shall be held responsible for injuries resulting from use of the property, including but not limited to the swimming pool. Guests are not allowed to let children swim unattended.
Basis of Rental.
The property is for short-term rental and is provided on a self-catering basis. We provide (through our Management Company) complimentary starter soap, toilet paper, and trash bags. Once these items are used, it is the guest’s responsibility to replenish them.
Force Majeur.
The owners shall not be liable for any costs or losses incurred due to delays or cancellations in the Guests vacation. Nor shall the guest have the right to terminate the Agreement for any delay or default in performing hereunder if such delay is caused by conditions beyond the homeowner’s control. These situations include but are not limited to: Death or illness in the family, Acts of God, War, Insurrections, Government restrictions, Natural disasters (earthquakes, hurricanes, floods etc). Riots or other major upheaval, Performance failures of parties outside the control of the contracting party (e.g., disruptions in telephone service attributable to the telephone company or labor actions by employees of a common carrier), any other cause beyond the reasonable control of the party who performance has become affected. We strongly suggest that all guests purchase low & reasonably costing Travel Insurance for their own protection
Hurricane Policy.
We the homeowners, do not offer refunds or reschedule trips due to hurricane activity. If you are concerned about possible interruption, cancellation or delayed travel due to tropical occurrences, you are strongly encouraged to purchase trip insurance at the time of booking (or at least 30 days prior to arrival). The peak season for tropical activity is August through October, and we strongly encourage all guests to purchase trip insurance, especially during these months.
Travel/Vacation Insurance.
We strongly recommend that all renters consider comprehensive travel insurance to cover cancellations and other non-refundable expenses.
Liability/Swimming Pool.
During you stay, the homeowners, our management company or owners agents DO NOT accept any liability whatsoever for death, personal injury, accidents, loss or damage to persons or personal effects however caused. The property has a swimming pool and spa, and the owners, MC and agents do not accept responsibility in the event of any injury or death caused as a result of the use of the pool or spa. All children must be supervised at all times by an adult. A child safety fence is provided and it is the guests responsibility to ensure that this is used at all times.
Arrival/Departure.
Check in is 4pm or after.
Check out is 10am strict unless otherwise pre-arranged. Cleaners will arrive at the property and must be allowed to enter.
No Smoking Policy.
Please note that we do not allow smoking with the villa, however smoking is permitted within the deck area.
Complaints/Repair Request
In the unlikely event of any complaint/repair request during you stay, please contact our Management Company immediately, contact details will be made available to you, thereby giving the MC the opportunity to remedy the problem during you stay. We cannot and will not accept complaints after your stay unless this procedure is followed.
Local Representation.
Our MC is there to assist you in making your vacation as enjoyable as possible. If you have any problems or questions please ask. Occasionally it may be necessary for the MC or their contractors to visit the home to undertake maintenance or repair work, every effort will be made to notify you in advance of this.
BBQ.
A BBQ is supplied at the villa. The rental agreement does not include for the supply of LPG gas for the BBQ. The use of the BBQ is at the renters own risk and the owners, MC or agents cannot accept any responsibility for injury of any description that may arise from the use of the BBQ. Renters take full responsibility for any use of the BBQ and the connection of gas bottles. Renters should remember to keep children away from BBQ whether is use or not. Guests are expected to clean the BBQ properly after use. If BBQ is left in a bad way, the fee for cleaning this will be taken out of the security deposit.
Pool Heating.
Pool heating is available at an extra charge and this must be ordered at the time of booking. The heating system uses an electric heat pump which relies on an air temperature of 58F or above. If for any reason the air temperature falls below this level the pool will not heat up. We cannot be held responsible if this occurs and no refunds will be made. Renters must not tamper or try to adjust ANY of the pool/heating controls. If found to have done so an excess charge equivalent to the pool heating fee will be deducted from the security deposit. During the winter months a pool/spa blanket is provided to help keep the pool/spa as warm as possible. We ask guests use the blanket each evening and when the pool is not in use.
Anti Social Behaviour.
Our home is located on a residential community where all house are privately owned, and all owners are subject to the Rules and Regulations of the Homeowners Association. Guests are also bound by these rules when they rent our home. As such we will not tolerate behaviour that is of an anti social nature, causes a nuisance to our neighbors or involve acts of violence towards any person or property. If for whatever reason the MC has to get involved in an event of an anti social nature requiring their attention, or the Sheriff’s Office has to be called to our villa, we reserve the right to have all the guests removed without recourse or financial recompense.
Data Protection.
We will take all reasonable precautions to keep any personal details you provide to us secure, but unless we are negligent, we will not be liable for unauthorized access to information supplied by you.
Jurisdiction.
This agreement shall be deemed to have been made in the United States and shall be subject to United States Law. The parties agree to submit to the exclusive jurisdiction of the courts of the United States of America.
